§1Scope

These Terms govern all contracts concluded via this website between Vogel Editions, Elena Vogel, [address] (hereinafter „Seller“) and the customer (hereinafter „Buyer“). The subject matter of sale is digital sheet music (PDF files) composed and published by the Seller. Deviating terms of the Buyer are not accepted unless agreed in writing.

§2Conclusion of contract

The presentation of scores on the website does not constitute a binding offer. By clicking the final purchase button and initiating payment via PayPal, the Buyer makes a binding offer. The contract is concluded when the Seller accepts the offer by capturing the PayPal payment. An automatic confirmation email constitutes acceptance.

§3Prices and payment

§4Delivery of digital content

Delivery is made exclusively in digital form: immediately after successful payment, the Buyer receives download links on the confirmation screen and by email. No physical goods are shipped. The Buyer is responsible for providing a correct email address and suitable hardware/software to open PDF files.

§5Grant of license (rights of use)

§6Right of withdrawal (Widerruf) — digital content

Consumers generally have a fourteen-day statutory right of withdrawal. For digital content not supplied on a physical medium, this right expires prematurely if the Seller has begun performance of the contract after the Buyer (1) has expressly consented to the commencement of performance before the end of the withdrawal period and (2) has confirmed knowledge that the right of withdrawal is lost upon commencement of performance (§ 356 (5) BGB). During checkout, the Buyer expressly provides both declarations by ticking the corresponding mandatory checkbox before payment.

§7Warranty

Statutory warranty rights apply. Defects of the digital files (e.g. corrupted files) will be remedied by providing a flawless replacement download. Minor deviations in layout or engraving do not constitute a defect.

§8Liability

The Seller is liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions (e.g. Produkthaftungsgesetz). For slight negligence the Seller is liable only for the breach of essential contractual obligations (Kardinalpflichten), limited to the typical foreseeable damage.

§9Data protection

Personal data (name, email address, payment data via PayPal) is processed solely for the purpose of contract performance and invoicing. Details are set out in the Privacy Policy (Datenschutzerklärung).

§10Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers, this choice does not deprive them of the protection of mandatory provisions of their country of residence. Place of jurisdiction — where legally permissible — is Berlin. Should individual provisions be invalid, the remainder of the contract remains unaffected (Salvatorische Klausel).
